1. Acceptance of these Terms

By accessing melusea.com, submitting an inquiry, uploading an RFQ or using information made available through this website, you agree to these Terms & Conditions. If you do not agree with these Terms, you should not use the website or submit information through its forms.

2. Scope of the Website

MELUSEA provides information about marine supply, ship chandling, technical procurement, spare-parts sourcing and vessel-support coordination. Website content describes general capabilities and supply categories. It is not a guarantee that a particular product, brand, certificate, service, port arrangement, lead time or delivery method is available for every vessel call.

The website is intended primarily for commercial and professional maritime users, including shipowners, ship managers, operators, charterers, masters, technical departments and purchasing teams.

3. RFQs and Information Supplied by the Customer

The accuracy of a marine supply quotation depends heavily on the information supplied with the RFQ. You are responsible for providing information that is sufficiently complete and accurate for the requirement, which may include vessel name, IMO number, port, ETA, ETD, delivery deadline, quantity, unit of measure, maker, model, part number, dimensions, voltage, frequency, pressure, material, approval standard, photographs and drawings.

MELUSEA may request clarification before quoting. A delay in receiving necessary technical or operational information may affect price, availability, lead time or the feasibility of delivery.

4. Quotations and Order Confirmation

Unless expressly stated otherwise, a quotation is an invitation to place an order and is subject to availability, final confirmation, commercial terms and the operational circumstances of the vessel call. A quotation does not create a binding obligation to supply until the order is accepted and confirmed under the applicable commercial terms.

Quoted prices, freight, launch, agency, customs, port, handling, delivery or other charges may be based on information available at the time of quotation and may change if the vessel schedule, delivery location, quantities, specifications, supplier pricing, exchange rates, local charges or other relevant circumstances change.

Quotation validity periods should be observed. If no validity period is stated, availability and price should be reconfirmed before order placement.

5. Product Availability, Brands and Substitutions

Availability can vary by port, country, customs jurisdiction, supplier stock and required delivery time. A product shown or described on the website should not be treated as guaranteed stock.

Where an exact requested item is unavailable, MELUSEA may propose an alternative where appropriate. Any material difference in maker, model, specification, pack size, origin, certification or technical characteristic should be disclosed where known. The customer remains responsible for reviewing and approving a proposed substitute before confirmation where technical compatibility or operational suitability is material.

6. Technical Specifications and Compatibility

Technical procurement is specification-sensitive. MELUSEA will use reasonable commercial efforts to identify products against the information provided, but final suitability may depend on manufacturer data, vessel-system details, class or flag requirements, installation conditions or other technical information not available to MELUSEA.

For equipment, spare parts, electrical components, valves, fittings, safety equipment, lifting gear and other technical items, the customer should review maker, model, part number, dimensions, ratings, certificates and other relevant data before approving an order.

Photographs or visual similarity alone do not establish interchangeability.

7. Delivery and Vessel-Call Coordination

Marine delivery is affected by factors outside the direct control of a supplier or coordinator, including berth changes, anchorage restrictions, port security, terminal rules, customs procedures, agent instructions, launch availability, truck access, weather, vessel delay, early sailing and changes to ETA or ETD.

Delivery times and methods are therefore subject to the live circumstances of the port call. The customer should communicate schedule changes as soon as possible. Additional costs created by changes to the vessel schedule, delivery location, access method or order scope may be chargeable where applicable.

8. Third-Party Suppliers and Service Providers

MELUSEA may coordinate requirements using independent suppliers, manufacturers, distributors, transport companies, vessel agents, launch operators, port-service companies or other third parties. Their own availability, approvals, operating conditions and terms may affect the final transaction.

References to third-party brands, products, standards, catalogues or manufacturers are for identification and sourcing purposes and do not imply ownership, partnership, authorization or endorsement unless expressly stated.

9. Compliance, Controlled Goods and Restricted Items

All supply activity is subject to applicable law, customs rules, export controls, sanctions, port requirements, safety restrictions and any other mandatory regulatory requirements that apply to the product, vessel, destination or transaction.

Certain bonded, chemical, safety-sensitive, controlled, hazardous or regulated goods may require permits, approved suppliers, certificates, declarations, special transport arrangements or may be unavailable at a particular port. MELUSEA may decline or limit an inquiry where supply would be unlawful, prohibited, unsafe or commercially impractical.

10. Payment and Commercial Terms

Payment method, currency, credit terms, bank charges, taxes, duties, delivery charges and other commercial conditions are determined by the specific quotation, pro forma invoice, order confirmation or other transaction document.

No website page should be interpreted as granting credit terms or fixing a universal payment condition for all customers or transactions.

11. Product Warranties and Documentation

Where a product carries a manufacturer or supplier warranty, that warranty may be subject to the issuing party's conditions, exclusions, installation requirements and claim procedures. MELUSEA does not create an additional manufacturer warranty merely by sourcing or coordinating the item.

Certificates, SDS documents, test reports, class documents, declarations or maker documentation should be specifically requested in the RFQ where they are mandatory. Their availability must be confirmed before order placement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, MELUSEA is not responsible for indirect, incidental, special or consequential losses arising solely from use of the website, including loss of profit, loss of opportunity, business interruption or loss resulting from reliance on general website content.

Any liability connected with a specific commercial transaction may be governed by the quotation, order confirmation, invoice, supplier terms or other agreed transaction document. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Force Majeure and Events Beyond Reasonable Control

Neither website information nor an anticipated supply schedule should be treated as overriding events outside reasonable control. These may include severe weather, port closure, strikes, war, civil disturbance, sanctions, embargoes, customs intervention, transport disruption, carrier delay, supplier failure, cyber incidents, natural disasters, governmental action or sudden changes to vessel schedule or port access.

14. Intellectual Property

Unless otherwise indicated, MELUSEA owns or is authorized to use the website design, text, layout, branding and original graphical material on melusea.com. You may view and use website content for legitimate business evaluation and procurement purposes, but you may not reproduce, republish, sell, scrape, impersonate or commercially exploit protected content without permission.

Third-party trademarks, maker names, IMPA/ISSA references and product identifiers remain the property of their respective owners.

15. Prohibited Website Use

You must not use the website to upload malicious files, transmit unlawful content, attempt unauthorized access, interfere with security controls, submit fraudulent inquiries, impersonate another business or person, or use automated systems in a way that materially disrupts website operation.

16. Governing Terms for Commercial Transactions

This website serves an international maritime market. The governing law, jurisdiction, dispute-resolution method and transaction-specific commercial terms for an actual order should be identified in the applicable quotation, order confirmation, invoice, contract or other agreed transaction document.

This page intentionally does not state a fictional company jurisdiction, registered address or court venue where those details have not yet been formally published by MELUSEA.

17. Changes to these Terms

MELUSEA may update these Terms to reflect changes in website functionality, commercial processes, legal requirements or service scope. The effective date shown at the top of this page identifies the current published version.
